These Terms of Use apply to the 365 Lions app for iPhone, iPad and Apple Watch as well as to the community features and the online service of 365 Lions. The provider is Ilja Mazar, Jakob-Kneip-Straße 22, 40595 Düsseldorf, Germany, email: support@365lions.app (more details in the imprint).
You download 365 Lions from Apple's App Store. Your use of the app is governed by Apple's Licensed Application End User License Agreement (EULA). These Terms of Use supplement the EULA, in particular for the community, the subscription and the online service. If the two conflict, the EULA prevails to the extent it is mandatory. Apple is not a party to these supplementary terms and is not responsible for the app's content or support.
365 Lions helps you train: tap counting, interval plans, history, the widget and saving to Apple Health are free. With Premium, the camera counts your reps on your device, you connect iPhone and iPad, plan your week, record runs with GPS, create clips and recaps and use the community. The community requires an account ("Sign in with Apple"). We keep developing the app; individual features may change if this is reasonable for you.
Camera counting is a training aid. It can make mistakes and is not tamper-proof evidence, for example for records.
The community works because everyone treats each other fairly. Before your first use, you agree to these rules in the app:
Gross insults in posts, comments, profile names, bios, crew names, training spots and meetups are rejected automatically. We review reported content promptly, usually within 24 hours.
We may hide or delete content that violates these rules or the law without prior notice. In case of violations we may temporarily suspend your account from posting or – for serious or repeated violations – suspend it permanently and delete your profile, taking the severity of the violation into account. If you believe a decision is wrong, write to support@365lions.app and we will review it again. In that case you cancel any running subscription yourself via Apple.
You may only use the community (profile, posts, comments, crews, training spots and meetups) if you are at least 16 years old. You confirm this in the app. All other features can be used without an account.
What you publish in the community (e.g. profile name, picture, bio, posts, photos, comments, training spots and meetups) remains yours. You grant us a simple, free right to store, display and technically adapt this content (e.g. image size) for operating the community for as long as it is online. Approved training spots may remain without any reference to you if you delete your profile. You are responsible for your content and make sure you have the necessary rights.
You can delete your account and data in the app at any time ("Delete profile on all devices"), even without Premium. Details are in the privacy policy.
365 Lions is not a medical device and does not replace medical advice, diagnosis or treatment. You train at your own risk. Listen to your body, progress gradually and plan rest days. Talk to a doctor before intense training – especially if you have pre-existing conditions, injuries, pain or are pregnant. Stop training immediately and seek medical advice if you feel pain, dizziness, shortness of breath or other discomfort. Heart rate, count and running values are training aids, not medical measurements. Watch out for traffic when running and for your surroundings at meetups.
Training works without internet. We provide the community and online service with reasonable care but cannot guarantee constant availability, for example during maintenance, outages or force majeure.
We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. In case of slight negligence we are only liable for breaches of essential obligations whose fulfilment makes proper use possible in the first place and on which you may rely, limited to the foreseeable, typical damage. Otherwise liability is excluded. We are only responsible for other users' content once we become aware of a legal violation. Your statutory rights as a consumer, including for defects in digital products, remain unaffected.
We may change these terms if the app, the law or Apple's requirements change. We will inform you of material changes in the app in good time. If the community rules change, the app will ask for your consent again.
German law applies. Mandatory consumer protection rules of the country in which you habitually reside remain unaffected. If any provision is invalid, the remaining provisions remain valid. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
